Maybe. The law is pretty limited with respect to third party liability for inaction. The classic example is walking by someone who is drowning - cant be held liable for doing nothing. The kids will probably have to prove that PSU owed them some duty, like with the Catholic church. Will be tough. The Second Mile is going to get pwned though.
