I was curious, so I looked it up in the enlightened Commonwealth of Virginia. Would be "Sexual Battery" here.
§ 18.2-67.4. Sexual battery.
A. An accused is guilty of sexual battery if he sexually abuses*, as defined in § 18.2-67.10, (i) the complaining witness against the will of the complaining witness, by force, threat, intimidation, or ruse, ......
*rape, forcible sodomy, inanimate or animate object sexual penetration, marital sexual assault, aggravated sexual battery, or sexual battery
§ 18.2-61. Rape.
A. If any person has sexual intercourse with a complaining witness, whether or not his or her spouse, or causes a complaining witness, whether or not his or her spouse, to engage in sexual intercourse with any other person and such act is accomplished (i) against the complaining witness's will, by force, threat or intimidation of or against the complaining witness or another person; or (ii) through the use of the complaining witness's mental incapacity or physical helplessness; or (iii) with a child under age 13 as the victim, he or she shall be guilty of rape.

I don't think anyone has claimed that every state views rape the same, although some of us are supporting the FBI's and state of Ohio's general definition of rape (e.g. regardless of object).
I'm no lawyer so maybe I'm reading the law wrong, but isn't there a separate charge for rape, inanimate or animate penetration and sexual battery? Although Virginia clearly views rape as different, the punishment for inanimate or animate penetration is similar (5 to life) except for consideration of mitigating circumstances. Again, not a lawyer so please forgive if I've read this wrong, but under VA code, while it's not rape like in Ohio, inanimate or animate penetration is not just sexual battery either, which I believe is a misdemeanor while the former is a felony.

penetrates the labia majora or anus of a complaining witness, whether or not his or her spouse,
other than for a bona fide medical purpose, or causes such complaining witness to so penetrate
his or her own body with an object or causes a complaining witness, whether or not his or her
spouse, to engage in such acts with any other person or to penetrate, or to be penetrated by, an

B. Inanimate or animate object sexual penetration is a felony punishable by confinement in the
state correctional facility for life or for any term not less than five years. In any case deemed
appropriate by the court, all or part of any sentence imposed for a violation under this section
against a spouse may be suspended upon the defendant's completion of counseling or therapy, if
not already provided, in the manner prescribed under § 19.2-218.1 if, after consideration of the
views of the complaining witness and such other evidence as may be relevant, the court finds
such action will promote maintenance of the family unit and will be in the best interest of the
SIAP, texts from some of the criminals. Good god.

This entire story troubles me on so many levels. I'm outraged that it took this long for the AG to decide to convene a Grand Jury to investigate this. It outrages me that all of this behavior took place with underage drinking. Who got them the booze? It took place at someone's home? Where were the parents?
If I were a parent of the girl or the boys involved, I would have been in jail for beating them to death for behaving as they did. It bothers me that the people testifying and who were clearly filming and texting and who were granted immunity, were all part of this despicable scenario and thought it was okay and funny. I hate it that the Police just wanted it to go away and be swept under the rug. There is just so much wrong here beyond the two convicted young men getting juvy from this. They and the entire community deserve much worse.

The state school board should shut down their football program for five years, but of course they wont.
Probably because their sons play on the team. Their opponents or conference/division could always ban them.
they have to get a judge from outside the area because everyone is part of that football program...no chance that ever happens.

The poor girl received threats after the verdict that resulted in the further arrests of two other girls. How stupid are kids today.
I can barely read about this case anymore.
