Handgun Debate

  • You better believe that I would feel threatened by someone chasing me in a car with a gun.

  • TerpPride,

I think you're having issues reconciling the fact that it's possible for both of these things to be legally true: (1) Martin was justified in his actions; (2) Zimmerman was justified in using deadly force.

[I'm not saying both ARE true, just that it's possible that they're true.]

if a woman is being tracked by a stranger where it is clear she is endangered, and traps her in an alley, she has to wait for him to pull out a knife or his dick before she can defend herself?

yes....because what if he says...my bad....you look just like this girl I know from high school. Or...can you tell me how to get to Chilis?

Being followed - or thinking you are being followed - is reason to be concerned. Doesnt give you license to preemptively attack someone phyiscally.

first off...you are aasuming that Martin even knew there was a gun at that point. Being followed - in of and itself - is not a basis to start swinging.

  • from the fox article. The girl's account differs from the communication between the two according to the police report. She says Zimmerman questioned what Martin was doing. Zimmerman claims he simply answered no to Martin's question which was phrased differently. And why would Zimmerman chase after martin only to supposedly avoid him so he could get back into his car? this is BS. something happened leading up to this. You track the guy and all of sudden you're like, "whoa, I've got no problem with you?"

BUTLER: Well, we hadn't heard George Zimmerman side really of the story except for a few of those witnesses like John. But today, the Sanford police did make it clear that what George Zimmerman told them was that he was actually getting back into his SUV when he said Trayvon Martin came around the left-hand side of him and he says that Trayvon Martin said, do you have a problem? And he said no, and then Trayvon said something like well, you do now. Then George Zimmerman told the cops that he got punched in the nose. He hit the ground, and that's when Trayvon Martin jumped on top of him and slammed his head into the sidewalk and that's when he began to yell for help. I mean, that's what Sanford police tell us that George Zimmerman told them.

  • It's entirely possible that, knowing Martin was shot, the girlfriend construed what Martin said or did in order to protect him.

You need to follow a person and then corner them in an alley to confirm identity or ask for directions? No, a reasonable person would yell "hey, Susie is that you?" or "hey, do you know where Chilis is?" My example clearly puts forth a tracking and cornering and potentially dangerous situation...like Martin's. along those lines, why didn't Zimmerman ever say, "I'm a neighborhood watch captain, what are you doing?" He didn't because he was under stress and was aggressive. Those simple words, just like the words of someone trying to get directions would take the fear out of someone being tracked.

true, and certainly true for zimmerman knowing he just killed someone. Does zimmerman's account of his retreat sound consistent with his behavior of running after Martin? his short answer of "no" indicates an omission of all of what took place. You don't create a manhunt situation and then act as if you want nothing to do with it. it's disjointed at the least.

    BTW, protect him from what?

I never said that or anything else is not possible. I am making case that it's possible Zimmerman's account, the basis for his self-defense claim, may not be the full truth. Is this unreasonable? if he partially lied, this does not affect his defense since this is simply he said or __ said. I've already said that if the law does not consider anything else other than Martin being on top of Zimmerman, then it's too bad.

BTW, if he lied, and there are account of more to the events, it would be too bad if this was not enough for probable cause-I think that's what you're saying.

Has anyone said where the shooting was in proximity to Zimmermans car? If he was about to get in his car then it should be obvious that Trayvon confronted him and the fight would have occurred right around the SUV.

If Zimmerman chased Martin and cornered him as some suggest, he's likely not going to be near his car.

That he was the aggressor? That he noticed Zimmerman following him and decided to confront him? Maybe she heard Martin ask him if he had a problem and that he had one now?

We'll have to see if she's willing to purger herself just to make Martin come across better.

She quoted a clear statement supposedly from Zimmerman. Are you saying she has confused what martin might have said?

again, can you explain why Zimmerman would track and run down Martin, supposedly corner him again and then just walk away where he is left to be attacked by surprise. I'm not saying it cannot happen as I'm only raising doubt-but what do you think took place for him to just give up and walk to his car?

No, that's not unreasonable. And yes, of course his account may not be the full truth. But that, in itself, doesn't necessarily end the debate and/or lead to probable cause...

It's possible, but isn't there only like a minute between his phone call ending and being shot? And during that time there are witnesses that saw them fighting, so the amount of distance they could theoretically cover between fights wouldn't be much.

  • TerpPride said...

If they fought and then re-engaged, that would actually help Zimmerman's argument (i.e., it would help remove some of the taint of Zimmerman being the initial aggressor)...

No, there are two different accounts as to how the struggle started (assuming it was one struggle). I'm saying if Zimmerman is right, she could be lying. If Zimmerman is lying then she is right.

    1) the girlfriend is on the phone with Martin, She says she heard Martin say "What are you following me for?" followed by a man's voice responding "What are you doing here?" She said that she heard the sound of pushing and that Martin's headset suddenly went silent, leading her to believe that he had been knocked down. She attempted to call him back immediately, but was unable to reach him

    2) Zimmerman told them that after he followed Martin, he lost track of him and was returning to his car. Zimmerman reported Martin then confronted him and asked "Do you have a problem?". Zimmerman said he replied no, and then reached for his cell phone. Zimmerman then alleged that Martin punched him in the face, knocking him down, and then began to beat his head against the ground. Zimmerman states that he called out for help while being beat, and that he then shot Martin in self defense

The conversation Martin and Zimmerman had prior to the scuffle is different in both accounts.

He wouldn't, no one is suggesting that.

Zimmerman says that he followed Trayvon, lost him and returned to his car before being attacked.

Another story is that he chased down Trayvon, cornered him and a fight ensued.

I'm confused...isn't that what I posted when I cited the Fox article? Just pointing out the inconsistencies. i think we agree. I couldn't say who is more truthful. the only thing I will assert is that Zimmerman's abbreviated account is suspicious to me. I interview witnesses in testimonies sometimes. I've found it easier to lie via telling half truths or by making statement with omissions than it is just to fabricate something.

    TerpPride

  • Even if Zimmerman verbally confronted Martin, and Martin was the one who took that first swing, does that give Zimmerman the right to kill him?

I'm not a lawyer, maybe it does, but it seems absurd the think that because I'm getting my ass beat in a fist fight I can kill you and walk away.

Zimmerman says that he followed Trayvon, lost him and returned to his car before being attacked.

Another story is that he chased down Trayvon, cornered him and a fight ensued.

So let's go with the first possible scenario. Why do you think he chased Martin?

so after losing him-Martin reappears and asked him why he's following him or do you have a problem and his only response is "no"??? Now he doesn't have a problem.

I'm not saying he could not have been attacked, but he easily could be painting himself as more of a victim to support his self-defense. He had no issue painting Martin before the confrontation.

    "they always get away..."
    "Fing ___"
    "he's probably on drugs"

Are you saying Zimmerman is a completely credible person? Given his role in the events, it's 100% reasonable to doubt his account of the events.

    TerpPride

  • I don't really get the point you're making. Yes, there is reason to doubt Zimmerman's account of events. So what? No one is disputing that and saying there's a 0% chance that Zimmerman is/was lying.
