Fight's a-brewin' between the Holder DOJ and Florida

    the country is soon to be a majority non white and white elders are doing everything in their being to prevent brown people from having any power....its a desperate last ditch effort to save "their" country.....honestly it just might work for another decade or so but eventually they will all die off and we can have the america we all "deserve"

    don't disagree with your analysis -- I think we will get the country we collectively deserve -- I don't think it will be the country that many of us want -- including the brown people that "white elders" have prevented from having power.

    Is it not better to remove the possibility of fraud, rather then have actual fraud upset an election because reasonable precautions were not taken"

    After all the link shows a laxity in monitoring who shows up at polls and vote

    I am not so sure the brown people in the majority are going to be so receptive or cooperative with African Americans in the minority. In fact there is some history that they take very opposite views in power struggles.

    Justice Department Files Lawsuit Against Florida Alleging Violations of the National Voter Registration Act

    WASHINGTON – The Department of Justice announced today that it has filed a lawsuit against the state of Florida and the Florida Secretary of State in his official capacity alleging that the state has violated its obligations under Section 8 of the National Voter Registration Act of 1993 (NVRA).

    The complaint, filed today in the U.S. District Court for the Northern District of Florida, alleges that Florida has violated the NVRA by conducting a systematic program to purge voters from its voter registration rolls within the 90-day quiet period before an election for federal office established by the law. In addition, the complaint alleges that Florida’s use of inaccurate and unreliable voter verification procedures violates the requirement in Section 8 of the NVRA that any such program be uniform and nondiscriminatory.

    “The Department of Justice has an overriding interest in protecting the rights of eligible citizens to register and vote free from unlawful burdens, while at the same time ensuring that ineligible persons do not register and vote in federal elections in violation of the law,” said Thomas E. Perez, Assistant Attorney General for the Justice Department’s Civil Rights Division. “The department is committed to enforcing the National Voter Registration Act so that these objectives are met.”

    The lawsuit seeks a court order declaring that the defendants have failed to comply with the requirements of Section 8 of the NVRA, and enjoining Florida from taking any further steps in connection with this list purge program.

    “Congress enacted the NVRA against a historical backdrop in this country in which purge programs initiated close to elections prevented and deterred eligible citizens from casting ballots,” said Assistant Attorney General Perez. “The 90-day quiet period in the NVRA protects eligible voters from being dropped from the rolls right before an election. It appears that Florida has undertaken a new program for voter removal within this 90-day period that has critical imperfections, which lead to errors that harm and confuse eligible voters.”

    But he could have, if he wanted to be caught voting instead of the US Attorney General. I think the odds are lower for voters showing up and voting for those on the rolls who are dead; they would have a much better chance of success. The absentee voters who are all suffering from dementia who have their ballots completed for them and mailed in is another example. I think many thousands of voters (in Bush vs Gore there were tens of thousands of such Florida voters from New Jersey alone) who through Motor Voter law pushed by Democrats have voting privileges in multiple States.

    They'll "go after" Corzine as soon as he's finished bundling cash for Obama, to the extent "go after" means giving him an ambassadorship to the Caymans.

  • Not sure which lawsuit came first...but when the DOJ is suing a state for something the state is endeavoring to do, but can't because it needs to sue another federal agency to do its job to help the state do its job, something's very wrong.

  • The suit was never in doubt. Right or wrong on the lawsuit it is political and the DOJ needs to be removed from the political landscape. The DOJ is a political pawn to the part that holds the WH. An apolitical DOJ is a better one.

    Judge Hinkle was not an unreserved supporter of the Florida program, but he rejected the legal basis for the DOJ challenge. The National Voter Registration Act specifies a 90-day “safe window” before elections, in which voter registration cannot be changed by the state, but Hinkle found that this provision “did not apply to removing non-citizens from the rolls.”

    He went on to say that “Determining citizenship is not as easy as the state would have it. Questioning someone’s citizenship isn’t as trivial as the state would have it.”
